Abstract:
This research is documentary research conducted to compare the grounds for filing for divorce and the reasons for the termination of marriage under the Civil and Commercial Code in Book Five: Families with the Islamic Law Guide on Family and Inheritance (Court of Justice Edition) 2011, Book One: Family by mainly comparing the similarities and differences. The problem with divorce in Thailand is that there has never been a law on divorce. However, the law in Section 1516 of the Civil and Commercial Code is clearly and concisely stated that if a spouse is unable to get divorced by consent, he or she can invoke the grounds for divorce as required by law as grounds for divorce from the other spouse by splitting into a cause for divorce caused by the fault of either spouse, such as adultery, physical harm deliberate abandonment and causes of divorce that are not caused by the fault of either spouse, such as separation, illness due to insanity, etc. The results of this study can be divided into the issue of comparing the reasons for divorce litigation and the reasons for the end of the marriage into three main points: 1) applicable law, 2) the reasons for divorce are the same in the four different issues, 3) the reasons why the marriage ends are the same on two different issues, so those involved should understand and spread it to the community or government agencies to lead to contextual reconciliation in the multicultural social dimension.
