Abstract: พระราชบัญญัติกองทุนเงินให้กู้ยืมเพื่อการศึกษา พ.ศ. 2560 มาตรา 47และ 48 ประกอบกับระเบียบคณะกรรมการกองทุนเงินให้กู้ยืมเพื่อการศึกษา ว่าด้วยการชา ระเงินกู้ยืมคืนกองทุน พ.ศ. 2542 แก้ไขเพิ่มเติม (ฉบับที่4) พ.ศ. 2552ข้อ 11 และข้อ 12 กำหนดให้ผู้กู้ยืมเงินที่ขอชำระหนี้ก่อน กำหนด หรือถูกกองทุนบอกเลิกสัญญานั้น ต้องชำระเงินกู้ยืมเพื่อการศึกษาทั้งหมดคืนกองทุนภายใน 30 วัน นับแต่วันถัดจากวันที่แจ้งบอกเลิกสัญญาหรือนับแต่วันถัดจากวันที่กองทุนแจ้งบอกเลิกสัญญาซ่วงต่างจากผู้กู้ยืมเงินที่สำเร็จการศึกษา หรือพ้นจากสภาพนักเรียนนักศึกษา ที่กำหนดให้ ปลอดภาระการชำระหนี้ 2 ปีและให้เวลาชำระหนี้คืน สูงสุด 15 ปีในอัตราดอกเบี้ยร้อยละ 1 ต่อปี ซึ่งกรณีดังกล่าวแสดงให้เห็นถึงปัญหาความไม่ เป็นธรรมของบทบัญญัติของกฎหมายอย่างเห็นได้ชัดผู้เขียนจึงมีข้อเสนอแนะในการแก้ไขเพิ่มเติมพระราชบัญญัติกองทุนเงินให้กู้ยืมเพื่อการศึกษา พ.ศ. 2560 มาตรา 47 และ 48 ประกอบกับระเบียบคณะกรรมการกองทุนเงินให้กู้ยืมเพื่อการศึกษาว่าด้วยการชำระเงินกู้ยืมคืนกองทุน พ.ศ. 2542 แก้ไขเพิ่มเติม (ฉบับที่ 4) พ.ศ. 2552 ข้อ 11 และข้อ 12 โดย กำหนดให้ผู้กู้ยืมเงินที่ไม่ประสงค์จะกู้ยืมเงินก่อนสำเร็จการศึกษา หรือถูกกองทุนบอกเลิกสัญญานั้น ได้รับสิทธิพิเศษในการปลอดภาระชำระหนี้ 6 เดือน ทั้งนี้ระยะเวลาในการชำระหนี้ไม่เกิน 15 ปี นับตั้งแต่วันถัดจากวันที่แจ้งบอกเลิกสัญญา หรือนับตั้งแต่วันถัดจากวันที่กองทุนแจ้งบอกเลิกสัญญา"

Abstract: From Section 47 and 48 of the Student Loan Fund Act B.E.2560, in conjunction with the Regulation of the Student Loan Fund Committee regarding Refunding of the Student Loan Fund B.E. 2542 amended (no. 4) B.E.2552 no. 11 and no.12, these laws require borrowers who were asked for paying off a debt before the due date or in case of termination of contract by the fund need to pay off their loans within 30 days from the date after notification of termination of contract or from the date after notification of termination of contract by the fund. This is different from the case of borrowers who graduated or out off student status of which the laws do not require to pay off their loans within 2 years and a maximum period in returning loans is 15 years with the 1 percent annual percentage rate. This reflects the unfair laws. The author therefore proposes to amend the Student Loan Fund Act B.E. 2560 Section 47 and 48 in conjunction with the Regulation of the Student Loan Fund Committee regarding Refunding of the Student Loan Fund B.E. 2542 amended (no. 4) B.E.2552 no. 11 and no.12 by providing that borrowers who do not intend to lend money before graduation or in case of termination of contract by the fund, borrowers shall not be obliged to pay off their loans within 6 months and a maximum period in returning loans should be set as 15 years from the date after notification of termination of contract by the fund.
