Abstract:
Commercial Bank is the financial and banking organization, which plays an important role in economic system as the major source of funding. Banking activities include money deposit, loan, credit facilities and other kinds of financial service provided according to customer purposes. Because most of the works deal with financial problems of the number of customers, the banking is the type of business that has a strong affect to most people.The undertaking of banking business requires both the expertise and new technology. When a problem occurs, it is difficult for people in general to understand the nature and solution. The problems, such as malfunction of electronic devices and ignorance of laws, may arise and create another fonn of conflicts among several commercial banks or conflicts between banking official and its customer.To cope with such problems there are many approaches applying. People may submit a complaint directly to financial organization, file a complaint to the Bank of Thailand and bring the case to court. However, there is no provision of law governing such procedures except for the last approach.For filing lawsuit, there are some disadvantages. In addition to time consuming, the parties are responsible for all expenses such as court fees and lawyer fees. Furthermore in civil procedure, the plaintiff obtains a burden of proof, which is difficult to whose ignorance in banking system. Therefore the special methods and other alternative dispute resolutions for banking cases are required to effectively protect people.The study indicates that commercial banks in other countries for examples, UK, Canada, Australia, India and Switzerland, each jointly and voluntarily established Banking Ombudsman as an independent organization to be in charge with banking perfonnance in its own country, The main purpose of Banking Ombudsman is to settle dispute or conflicts arising from recommendation for the parties to settle disputes amicably. The working of Banking Ombudsnian has been widely accepted as an effective method for a dispute resolution.The annual reports also show that there are alarge number of disputes have been settled by Banking Ombudsman every year.This thesis proposes to thc establishment of Banking Ombudsman in Thailand. The law shall be drafted to guarantee the status of which as an independent organization being responsible for dispute settlement between a bank and its customer with amicably. Accordingly, banking customer are ensured that when problems arise, they are entitled to find another alternative to settle a dispute with fairness and speedy procedure.
