Abstract:
Internet TV is a programme distributing service on the same way as TV programme via internet network. It is new media originated from the convergence of television and internet technologies. This character makes Internet TV a borderless service capability media with low production cost as well as other internet contents. As a result, applying the current legislative measures in monitoring television to be used with Internet TV operators might be inappropriate because of the legislative jurisdiction obstacles. Moreover Thailand has no legislation to monitor internet content, Thailand thus has no measurement in monitoring inappropriate content distribution of Internet TV operators. It causes some inequality between television broadcasters and internet TV operators as well as the lack of consumer protection from inappropriate contents. Study found that theres no international monitoring method. In Thailand legislative measure to monitor inappropriate contents can be done since the constitution law has opened for the state to enact the law to protect the people. Most academics view that it should be done by regulate the old television broadcasters who have on-lined their programmes by the current legislative measures in monitoring television. This thesis has suggested that there should be the separation of Internet TV regulation - 1. The circumstance that the provider is in the kingdom, there should be regulated by enforcing television broadcasters control measures, 2. The circumstance that provider is outside the kingdom should be regulated by self-regulation measures together with the use of Lex Electronica
