Abstract:
The objective of this thesis is to study the factors justi1 the budget allocation of the office of the judiciary to its subsidiary agencies according to their responsibilities. The study will focus on the budget management of the Ministry of Justice in the sections of judge work and judicial affair work during 1995 - 1999 befor the court has been separated from the Ministry and become an independent institution. The administrative structure and budget allocation of the office ofjudiciary during 2000 -2001 are also studied in order to find the more efficient process of budget appropriation for the best adventage of general public.The study found that the budget allocation of the office ofjudiciary was subjected to the budgeting policy, main duties of each agencies, structure of working plan, personnel, investment on land, building and hardware, and the organization development.On the average, approximately 65% of the budget was allocated for the expense on wage, salary, and emolument of judiciary officers and employees, while 20% and 15% were allocated for investment and operational management. In order to maximize the efficiency of budget allocating system, the appropriation process should be based on clarity, transparency, and concreteness but also allowing for flexibility in budget management when necessary.As an independent organization according to the Constitution of the Kingdom of Thailand B.E.2540 which assume responsibility to serve public justice. the office of judiciary should allocate its budget by emphasizing on 6 important tasks as follow:1) increasing the efficiency of adjudication of the court of justice2) increasing the efficiency of the office's administrative management3) enhancing the potentiality ofjudiciazy services4) cooperating with other government agencies, people, and communities to promote public justice5) supporting the role of the court of justice in protecting the right and liberty Thai citizen6) creating a system allowing people to examine and check the clarity and transparency ofjudiciary work.
