Abstract:
To investigate pollution problem from industry and the impacts on workers and people, compensation problem for damage in judicial system, the limitation of the Environmental Promotion and Conservation Act : 1992, and the proper establishment of The fund for the industrial pollution sufferers. The study was conducted by documentary analysis and in-depth interview. The case study of industrial pollution, Mae moh electrical generating factory and Khungthep textile factory, found people living nearby electrical generating factory have got chronic lungs diseases caused by sulfer dioxide. The workers in textile factory who inhale cotton dusts get Byssinosis disease causing wheezing, shortness of breathing, tightness of the chest, and coughing. The victims of two cases study have sued for compensation from both government sector and through court, but the existing measure can not alleviate their problems. Moreover there is the problem of limitation on environmental fund which does not cover the industrial polluted sufferers. So the government should use the economic and legal measures to recover those sufferers by establishing the remuneration fund. This remuneration fund should resemble the successful environmental fund in Japan.
