Abstract: This study was to investigate principles, concepts and nature of work of interrogation officers in gang rape cases; to investigate problems and limitations related to addressing the cases of gang rape by the interrogation officers; to investigate viewpoints and recommendations of male interrogation officers on involving female interrogation officers in the cases of gang rape; and to investigate the relationships between personal data and other factors related to inquiries in cases of gang rape investigated by interrogation officers in the police stations under supervision of Metropolitan Police Division 9. The samples were 119 commissioned officers working on inquiry jobs in 10 police stations. A Questionnaire was used in data collection and the statistical applications were percentage, mean, standard deviation, ANOVA and Pearson’s MCA (multiple classification analysis). The results were: 1. Most Samples had 1-5 years of police tenure, ranked as police lieutenant, had earned a bachelor degree with salary of 10,000 – 15,000 Baht a month, and had been allocated to the inquiry jobs for more than 6 years. In addition, by personality, most samples were calm, rational, even-tempered and helpful. 2. Factors related to inquiry procedures in the gang rape cases were that most rape victims were 15-25 years and most of the police had experience handling 3-4 rape cases. Most victims moderately cooperated in the inquiries on rape cases. In addition, most samples found that causes of non-cooperation from victims were fears of social disgust, of being defamed, and of being humiliated. The procedures of inquiry on rape cases at the time were not satisfactory. 3. Test of hypotheses revealed that viewpoints on involving female interrogation officers in the gang rape cases were affected by police tenure (Sig. = 0.001), education (Sig. = 0.001), rank (Sig. = 0.023), age (Sig. = 0.032), age of victim (r = 401), experience in inquiry of rape cases (r = .567), cooperation of victim (r = .463), procedures fit for inquiry of rape cases (r = 631), general principles for inquiry (r = 312), concepts of inquiry (r = .401), problems and limitations (r = .479) and ethics of interrogation officer (r = .568) respectively. Recommendations from the research are that complicated and prolonged steps in proceedings beginning from the interrogation officer, prosecutor, and court should be reduced. These alienated victims and they were likely to refuse to cooperate with government agents.

Abstract: การศึกษาในครั้งนี้มีวัตถุประสงค์เพื่อศึกษาถึงหลักการ แนวความคิดและลักษณะการปฏิบัติงานของ พนักงานสอบสวน เพื่อศึกษาถึงปัญหาและอุปสรรคในการปฏิบัติงานเกี่ยวกับคดีข่มขืนกระทำชำเราของพนักงาน สอบสวน ที่เกี่ยวข้องกับการปฏิบัติงานเกี่ยวกับคดีข่มขืนกระทำชำเราของพนักงานสอบสวนในสถานีตำรวจใน สังกัดกองบังคับการตำรวจนครบาล 9 กลุ่มตัวอย่าง ได้แก่ เจ้าหน้าที่ตำรวจชั้นสัญญาบัตรที่ปฏิบัติหน้าที่เป็น พนักงานสอบสวนในสถานีตำรวจสังกัดสถานีตำรวจนครบาล 9 รวม10 สถานี จำนวนทั้งสิน 119 ราย สถิติที่ใช้ ในการวิเคราะห์ข้อมูล ได้แก่ ค่าร้อยละ ค่าเฉลี่ย ส่วนเบี่ยงเบนมาตรฐาน การวิเคราะห์ความแปรปรวน การ วิเคราะห์การจำแนกพหุและการคำนวณค่าสัมประสิทธิสหสัมพันธ์แบบเพียร์สัน ผลการวิจัยสรุปได้ ดังนี้ 1. กลุ่มตัวอย่างมีอายุต่ำกว่า 30 ปี มีระยะเวลาในการรับราชการตำรวจ 1-5 ปี ชั้นยศร้อยตำรวจ โท จบการศึกษาระดับปริญญาตรี มีรายได้ต่อเดือนประมาณ 10,000-15,000 บาท ปฏิบัติงานในตำแหน่งพนักงาน สอบสวนมาแล้วเป็นระยะเวลามากกว่า 6 ปีขึ้นไป เป็นคนที่มีนิสัยหรือบุคลิกภาพส่วนตัว ใจเย็น มีเหตุผล โกรธ ง่ายหายเร็ว และชอบช่วยเหลือผู้อื่นเป็นประจำ เป็นต้น 2. ปัจจัยที่เกี่ยวข้องกับการดำเนินงานด้านการสอบสวนในคดีข่มขืนกระทำชำเรา พบว่า ผู้เสียหายหรือผู้หญิงที่ถูกข่มขืนส่วนใหญ่มีอายุ 15-25 ปี เคยทำการสอบสวนคดีเกี่ยวกับการกระทำผิดทางเพศ มาแล้วจำนวน 3-4 คดี ได้รับความร่วมมือจากผู้เสียหาย อยู่ในระดับปานกลาง 3. ผลการทดสอบสมมติฐาน พบว่า อายุราชการ (Sig.=0.001) ระดับการศึกษา (Sig.=0.011) ชั้น ยศ (Sig.= 0.023) และอายุ (Sig.=0.032) อายุของผู้เสียหาย (r=.401) การมีประสบการณ์ในการสอบสวนคดีที่ เกี่ยวกับการกระทำผิดทางเพศ (r=.567) ความร่วมมือจากผู้เสียหายในการสอบสวน (r=..463) ความเหมาะสมของ ขั้นตอนการดำเนินงานสอบสวนคดีความผิดเกี่ยวกับการข่มขืนกระทำชำเรา (r=.631) หลักการทั่วไปเกี่ยวกับการ สอบสวน (r=.312) แนวคิดที่เกี่ยวกับการสอบสวน (r=.401) ปัญหาอุปสรรคต่างๆ เกี่ยวกับการสอบสวน (r=.479) และจรรยาบรรณของพนักงานสอบสวน (r=.568) ตามลำดับ ข้อเสนอแนะจากการวิจัย ควรมีการลดขั้นตอนในกระบวนการยุติธรรมของไทยนับตั้งแต่พนักงาน สอบสวน อัยการ ศาล ซึ่งเป็นขั้นตอนที่ยุ่งยากและใช้เวลานาน ทำให้ผู้หญิงที่ตกเป็นผู้เสียหายในคดีความผิด เกี่ยวกับเพศเกิดความเบื่อหน่ายและไม่อยากให้ความร่วมมือกับเจ้าหน้าที่ของรัฐ
